On August 1, 2023, the prohibition on adult possession and use of cannabis and cannabis products will end and it will be legal across Minnesota for adults age 21 and over to possess, use, transport, and grow cannabis for personal use according to new Minnesota laws.
The Leech Lake Reservation Business Committee is preparing the Leech Lake Band of Ojibwe Cannabis Regulatory Act that will provide for licensing of cannabis businesses within the jurisdiction of the Leech Lake Band of Ojibwe and will be releasing a draft version for public review and comments in the near future. The Leech Lake Band of Ojibwe Reservation Business Committee, by Resolution No. 2024-08, approved on July 27, 2023, prohibits:
- vaporizing or smoking cannabis flower, cannabis products, artificially derived cannabinoids, or hemp-derived consumer products in any public place within the Leech Lake Indian Reservation, including but not limited to, casinos, restaurants, bars, pow-wow grounds and campgrounds, government buildings, parking lots, public parks, playgrounds, and all lands owned by the Band or for that benefit of the Band unless dedicated to the use of an individual Band member.
Minnesota law allows personal possession of:
- Up to two (2) ounces of cannabis flower in a public place; and,
- Up to two (2) pounds of cannabis flower in an individual’s private residence; and,
- Up to eight (8) grams of cannabis concentrate in any location; and,
- Edible cannabis products and lower-potency hemp edibles containing up to a combined total of 800 milligrams of THC; and,
- Up to eight (8) cannabis plants in a private residence without a license, no more than four (4) plants can be mature, flowering plants, in an enclosed, locked area that is not open to public view.
Minnesota law permits the transfer for no remuneration (compensation) to an adult at least 21 years of age:
- Up to two (2) ounces of cannabis flower; and,
- Up to eight (8) grams of cannabis concentrate; and,
- Edible cannabis products and lower-potency hemp edibles containing up to a combined total of 800 milligrams of THC.
Minnesota law permits adults age 21 and over to use cannabis flower and adult use cannabis products in the following locations:
- A private residence; and,
- On private property, not generally accessible by the public, unless the property owner explicitly prohibits consuming cannabis on the property; and,
- On the premises of an establishment or event licensed to permit on-site cannabis consumption.
Minnesota law prohibits:
- use, possession, and transportation of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products by individuals under 21 years of age; and,
- use of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a motor vehicle; and,
- use or possession of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a public school, including all facilities, whether owned, rented, or leased, and all vehicles that a school district owns, leases, rents, contracts for, or controls; and,
- use or possession of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a state correctional facility; and,
- operation of a motor vehicle while under the influence of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products; and,
- vaporizing or smoking cannabis flower, cannabis products, artificially derived cannabinoids, or hemp-derived consumer products in any location where the smoke, aerosol, or vapor would be inhaled by a minor; and,
- Home extraction of cannabis concentrate by use of volatile solvent; and,
- Sale of cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products without a valid license for sales.
